Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of AirCreator and its products (the "Service"), operated by AIRCREATOR.COM LLC, a Puerto Rico limited liability company ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, you may not use the Service.

You must be at least 14 years of age to use AirCreator. If you are between 14 and the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and consented to these Terms on your behalf.

2. Description of Service

AirCreator is an AI-powered content platform that provides three core products:

  • AirClone — analyzes your top-performing social media videos to model your writing style, tone, and topics, and generates an AI Clone profile that produces content suggestions in your style.
  • AirPublish — lets you upload, schedule, and publish video and text content to your connected YouTube, Instagram, Facebook, TikTok, Pinterest, and Threads accounts.
  • AirIdeas — discovers content opportunities in your niche and generates personalized content ideas, hooks, titles, and scripts using your AI Clone.

3. Account Registration

To use the Service you must create an account using OAuth via Google, or by email and password. By registering, you agree to:

  • provide accurate and complete information at signup,
  • be responsible for all activity that occurs under your account,
  • notify us immediately of any unauthorized access to your account,
  • not create multiple accounts representing the same individual without our consent,
  • keep your connected platform credentials and authorizations secure.

4. Third-Party Platform Integration

AirCreator integrates with third-party platforms, including YouTube, Facebook, Instagram, TikTok, Pinterest, and Threads. By connecting these platforms to AirCreator, you also agree to be bound by their respective terms:

You acknowledge that the availability and behaviour of third-party platforms is outside our control and may change at any time, and that AirCreator's features depend on those platforms continuing to provide their APIs.

5. User Content and License

You retain full ownership of all content you create, upload, or connect to AirCreator (your "User Content").

By using the Service, you grant AIRCREATOR.COM LLC a limited, revocable, non-exclusive, royalty-free licence to:

  • access, fetch, and process your video metadata and audio from your connected platforms in order to build and refine your AI Clone profile,
  • store uploaded files and AI Clone outputs on our managed cloud infrastructure for the purpose of providing the Service to you,
  • publish content to your connected platforms only when you explicitly initiate or schedule a publish action.

This licence is granted solely to enable us to operate the Service for you. It terminates when you disconnect a platform or request account deletion, except that we may retain copies of your User Content as described in our Privacy Policy until your deletion request is processed.

6. AI Training and AI-Generated Content

Training of your AI Clone. AirClone uses your videos and their transcripts to build an AI Clone profile of you, intended to model your writing style, tone, vocabulary, and topics. By using AirClone, you expressly consent to:

  • our fetching audio from up to 50 of your top-performing videos on a connected platform,
  • our transcribing that audio using third-party transcription services,
  • our analyzing those transcripts (along with related metadata) using third-party AI services to generate your AI Clone profile,
  • our storing your AI Clone profile, which may include verbatim excerpts from your videos such as your signature lines and recurring phrases, until you request account deletion.

We do not use your videos, audio, transcripts, or AI Clone profile to train general-purpose AI models or models for any user other than you.

AI-generated content responsibility. Outputs produced by your AI Clone or by other AI features of the Service are generated based on your inputs and your connected platform data. You acknowledge and agree that:

  • you are responsible for reviewing all AI-generated content before publishing or distributing it,
  • we do not guarantee the accuracy, originality, appropriateness, or non-infringement of AI-generated content,
  • we do not guarantee any specific business, audience, or performance outcome,
  • you are responsible for ensuring AI-generated content complies with applicable law and the rules of any platform on which you publish it.

7. Acceptable Use

You agree not to use the Service to:

  • engage in any unlawful, fraudulent, deceptive, or harmful activity,
  • infringe the intellectual property, privacy, or other rights of any person,
  • build an AI clone of a person other than yourself, or impersonate another person, without that person's verifiable consent,
  • upload or generate content that is sexual, violent, harassing, hateful, or otherwise objectionable under our discretion,
  • reverse engineer, decompile, or attempt to derive source code or model weights from any part of the Service,
  • use bots, scrapers, or automated tools against the Service in a manner that disrupts or burdens it,
  • circumvent or interfere with security measures, rate limits, or platform integrations,
  • distribute malware, viruses, or any other harmful code,
  • send spam, unsolicited advertising, or any communication that violates the rules of a connected platform.

We may suspend or terminate access to the Service for any user who, in our reasonable judgement, violates this section.

8. Publishing and Scheduling

  • When you initiate or schedule a publish action via AirPublish, AirCreator acts as your authorized agent to publish to your connected platforms.
  • You are solely responsible for ensuring that the content you publish complies with the rules and policies of those platforms.
  • We are not liable for content removals, demonetizations, strikes, suspensions, or other enforcement actions taken by a platform against your account.
  • Scheduled publishing depends on your OAuth connections remaining active and the connected platforms' APIs remaining operational. We do not guarantee that all scheduled posts will publish successfully or on time.

9. Intellectual Property

The AirCreator platform — including its software, source code, design, branding, logos, documentation, and any improvements, derivatives, or feedback we incorporate — is owned by AIRCREATOR.COM LLC and is protected by applicable intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights in the Service.

10. Privacy

Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.

11. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, AIRCREATOR.COM LLC and its affiliates, employees, and contractors will not be liable for:

  • loss of data, content, revenue, profit, business, or goodwill,
  • failed, delayed, or incorrect publishing of scheduled content,
  • changes to or unavailability of third-party platform APIs,
  • inaccuracy, infringement, or unsuitability of AI-generated content,
  • any indirect, incidental, special, consequential, exemplary, or punitive damages.

To the maximum extent permitted by law, our aggregate liability for all claims arising out of or relating to the Service is limited to the greater of (a) the amounts you paid to us for the Service in the twelve months preceding the claim, or (b) one hundred United States dollars (USD 100).

12. Warranty Disclaimer

To the maximum extent permitted by law, AIRCREATOR.COM LLC makes no warranties, express or implied, regarding the Service, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, error-free, or secure.

13. Indemnification

You agree to indemnify and hold harmless AIRCREATOR.COM LLC and its affiliates, employees, and contractors from and against any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your User Content or content you publish through the Service, (c) your breach of these Terms or of any law, or (d) your infringement of any third party's rights.

14. Termination

Termination by you. You may stop using the Service at any time. You may disconnect a connected platform from within AirCreator, and you may request full account deletion by emailing support@aircreator.com.

Termination by us. We may suspend or terminate your access to the Service if you breach these Terms, if continued service to you would expose us to legal or platform-policy risk, or if we discontinue the Service.

Effect of termination. Disconnecting a platform marks your platform connection as inactive within AirCreator and stops further data collection from that platform on your behalf. Disconnection does not, by itself, erase data we have already collected. To request permanent deletion of your account and the data we hold, follow the process described in §12 of our Privacy Policy. Sections that by their nature should survive termination — including §5 (your User Content licence to the extent already exercised), §9, §11, §12, §13, §15, and §16 — will survive.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes we will attempt to notify you by email or in-product. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and, where applicable, the federal laws of the United States, without regard to conflict-of-laws principles. Disputes arising out of or relating to the Service or these Terms will first be addressed through good-faith negotiation, and otherwise are subject to the exclusive jurisdiction of the courts located in San Juan, Puerto Rico.

17. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be enforced to the maximum extent permissible.
